STOODMARK
Terms of Use
These Terms govern your use of the Stoodmark iPhone app and the website stoodmark.com (together, the "Service"), provided by NODIS, LIMITED LIABILITY COMPANY (合同会社Nodis, "we", "us"). By using the Service you agree to these Terms.
1. The Service
- The Service tells how World Heritage sites came to be, and lets you record the countries and sites you have stood in and the sites you want to visit.
- If you allow it, the iPhone app reads when and where your photos were taken, on your phone, and suggests countries and sites you may have stood in. Suggestions are estimates from photo locations and may be wrong. You decide what to record.
- The Service is free today. If we offer paid features, we will set out their terms separately before you buy anything.
2. Age
You must be at least 16 to create an account. If you are a minor, use the Service with your parent's or guardian's consent.
3. Your account
- An account is optional. You sign up with your email address.
- Keep your email account and your sign-in codes and links to yourself.
- You can delete your account at any time with "Delete account" in the account section of the app, or in the account section of the "Record" tab on the website. This also deletes the records stored in your account and your public passport, and cannot be undone. The record on your phone or in your browser stays.
4. Your record
- What you enter or choose (sites, dates, wishes, countries, the name on your share images) belongs to you.
- We store, copy and display your record only as needed to provide the Service. We may produce and show statistics that identify no one (for example, how many people stood at a site).
- Our Privacy Policy explains how we handle your information.
5. Public passport
- You can pick a name (handle) in your account settings and turn on a public passport at stoodmark.com/@name. It is off by default. Our Privacy Policy explains what is and is not shown.
- Anyone can see a public passport. Turning it off stops publication, but we cannot remove copies that others saved or reposted before that.
- Names are 3–30 characters: a–z, 0–9, "." and "_". Names we have reserved, such as service names, official titles, brand names and names of historical figures, cannot be used.
- We may stop publishing a passport or ask you to change its name without notice if the name impersonates someone, misuses someone else's trademark in a misleading way, defames others or otherwise breaks section 8.
- If you think a public passport is a problem, contact us (section 17).
6. Share images
- Share images are created on your phone and posted to other services by you. Follow those services' rules.
- If a share image uses your own photos, make sure you have the right to post them, and respect the rights and privacy of people who appear in them.
- World Heritage photos from Wikimedia Commons are used under each photo's licence. Do not remove the credit shown on the image.
7. Rights
- The stories, design, seal designs, logo and software of the Service belong to us or their rightful owners.
- World Heritage photos are works of their photographers on Wikimedia Commons, under the licence shown with each. Base data on the sites comes from sources such as Wikidata (CC0).
- You may use the Service's content for personal use and share it with the Service's share features. You may not republish or sell the stories beyond that.
8. What you must not do
- Break the law.
- Sign up with someone else's email address or pretend to be someone else.
- Overload, attack or gain unauthorised access to the Service, or interfere with its operation.
- Collect the Service's content in bulk by automated means without our permission.
- Infringe others' rights (copyright, image rights, privacy and so on).
- Use the name on your share images or public passport to defame others or to misuse someone else's trademark in a misleading way.
9. Accuracy and travel safety
- Stories are written from sources we have checked, but may contain errors. Please tell us if you find one.
- The Service does not provide directions, opening hours, safety information or entry requirements. Check official and local sources before you travel. Map and direction links open external services such as Google Maps.
10. Changes, interruptions and ending the Service
- We may change or stop the Service. If we stop it, we will give reasonable notice in advance and explain how to export the records stored in your account.
- We may interrupt the Service for maintenance, faults, disasters or failures of our providers.
11. Suspension
If you break these Terms, we may suspend or delete your account without notice.
12. Liability
- The Service is provided as it is. We do not promise that it is free from defects, errors or security issues, or that it fits a particular purpose.
- We are not liable for loss arising from the Service except where caused by our intent or gross negligence. Where your contract with us is a consumer contract under Japanese law, our liability for loss caused by our ordinary negligence is limited to ordinary, direct loss up to JPY 10,000.
- If you live in the EU, the UK or another country whose law does not allow these limits, they apply only as far as that law allows. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.
- Records kept only on your device can be lost if the device fails, is replaced, the app is deleted or browser data is cleared. To keep your record, create an account or use the website's export.
13. Apple (iPhone app)
- These Terms are between you and us, not Apple Inc. ("Apple"). We, not Apple, are responsible for the app and its content.
- The App Store's terms, including the Licensed Application End User License Agreement, also apply to the app.
- Apple has no obligation to provide maintenance or support for the app. We handle any questions, complaints, product claims or claims that the app infringes someone's intellectual property.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you once you accept them.
- You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
14. Changes to these Terms
We may change these Terms under Article 548-4 of the Japanese Civil Code. We will announce the new Terms and the date they take effect in the Service before that date.
15. Governing law and courts
- Japanese law governs these Terms. If you are a consumer, you keep the mandatory protections of the law of the country where you live.
- The Tokyo District Court has exclusive jurisdiction in the first instance. If you are a consumer, this does not take away your right to bring or defend a claim in the courts of the country where you live.
16. Language
These Terms exist in Japanese and English. If they differ, the Japanese version prevails, unless the law requires otherwise.
